Forensic Weather Analysis Helps Dismiss New Jersey Slip-and-Fall Ice Claim

Investigating a Sidewalk Slip-and-Fall Claim in North Bergen 

The plaintiff alleged that accumulated snow and ice on a sidewalk at Columbia Park Center caused him to slip and fall. There had been no natural snow or ice on the ground the day before the incident, making the timing and progression of the winter storm central to determining whether frozen ice could have formed on the sidewalk. 

On the day of the incident, a powerful winter storm produced approximately 5 to 6 inches of heavy, wet snow during the afternoon. The snow changed to rain during the evening, causing some of the accumulation to melt and turn into slush. Runoff from the rainfall and melting snow collected in puddles across low-lying areas and locations with poor drainage.

Comparing the Plaintiff’s Testimony With the Weather Evidence 

The plaintiff testified that approximately 4 inches of slush remained on undisturbed sidewalks late that evening and that slush was flowing down an adjacent viaduct. AccuWeather determined that these observations were consistent with the documented weather conditions. 

The plaintiff also stated that after walking over a hump in the sidewalk, the slush changed to frozen solid ice, causing him to fall. AccuWeather found that this portion of his testimony was not supported by the meteorological evidence. 

Above-Freezing Temperatures Challenged the Ice Claim 

Air temperatures at the time were approximately 37 to 38 degrees. Under those conditions, water and slush produced by rainfall and melting snow would not be expected to freeze into solid ice. The storm’s snowfall had also changed to rain only a few hours before the incident, leaving limited time for snow-removal operations after the winter weather ended. 

Evidence Used in the Forensic Weather Analysis 

AccuWeather Expert Forensic Meteorologist Robert Smerbeck reviewed daily weather maps from the National Centers for Environmental Prediction’s Hydrometeorological Prediction Center, local climate records from the National Centers for Environmental Information, daily precipitation and snowfall measurements, AccuWeather proprietary datasets, photographs of the incident location, and the plaintiff’s testimony. Together, these sources provided a detailed reconstruction of conditions at the time and place of the reported fall.

Case Outcome 

AccuWeather’s analysis demonstrated that while wet snow, slush, runoff, and puddles were consistent with the storm, the claim that the slush had become frozen solid ice was inconsistent with the above-freezing temperatures. The judge granted the defense’s motion for summary judgment and dismissed the case. 

The defense attorney credited the forensic weather analysis as a critical factor in securing the dismissal, stating: 

“Thank you again for all your help. We could not have gotten the case dismissed without your analysis of the weather.”
